Acceptance of Terms

By accessing or using prorigbuilder.com, the Pro Rig Scanner application, or any related service ("Services"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, you may not use the Services.

The Services are owned and operated by TieredUp Tech, Inc. ("Company," "we," "us," "our"), a Texas S-Corporation.

Eligibility

You must be at least 13 years old to use our Services. By using the Services, you represent that you meet this age requirement and that you have the legal capacity to enter into a binding agreement.

Use of the Services

Pro Rig Builder provides tools for comparing PC hardware prices, checking compatibility, generating builds, and related functionality. You may use the Services for personal, non-commercial purposes.

You agree NOT to:

• Scrape, crawl, or automate data collection from the Services without our written permission
• Reverse-engineer, decompile, or otherwise attempt to extract source code
• Use the Services to compete directly with Pro Rig Builder
• Attempt to gain unauthorized access to our systems, other users' data, or any connected networks
• Upload viruses, malware, or any malicious code
• Use the Services for any illegal purpose or in violation of any applicable laws
• Misrepresent your identity or affiliation
• Interfere with or disrupt the Services or servers

Pricing & Availability Information

Pro Rig Builder aggregates pricing and availability data from third-party retailers. We make reasonable efforts to keep this information accurate and up-to-date, but we cannot guarantee that prices, stock status, or product specifications displayed are current at all times. Always verify pricing and availability on the retailer's website before making a purchase.

We are not responsible for errors, omissions, or outdated information. Reliance on our data is at your own risk.

Compatibility & Build Recommendations

Our compatibility engine, FPS estimator, bottleneck calculator, and other tools provide informed estimates and guidance based on manufacturer specifications and community data. These are not guarantees. Real-world performance varies based on many factors we cannot fully model.

You are solely responsible for verifying compatibility and suitability before purchasing components or assembling a PC.

All content on Pro Rig Builder — including the website design, code, logo, Pro Rig Scanner application, written content, and compiled product data — is owned by TieredUp Tech, Inc. or its licensors and protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Services without our written permission. Product images, manufacturer logos, and specifications belong to their respective rights holders.

Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TIEREDUP TECH, INC., ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES.

OUR AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.

Indemnification

You agree to defend, indemnify, and hold harmless TieredUp Tech, Inc. and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Services or violation of these Terms.

Our Services contain links to third-party websites and services (retailers, manufacturers, review sites). We are not responsible for the content, privacy practices, or availability of third-party sites. You access third-party sites at your own risk.

Termination

Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Services shall be resolved exclusively in the state or federal courts located in Orange County, Texas.

We may modify these Terms at any time. Updates will be posted on this page with a revised "Last updated" date. Your continued use of the Services after changes constitutes acceptance of the modified Terms.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.
